Families Experiencing Homelessness

 
The McKinney-Vento Homeless Assistance Act
 
The McKinney Vento Act is a federal law that aims to ensure children and youth experiencing homelessness have the right to a free and appropriate public education, and that school districts make a dedicated effort to remove barriers to education for children and youth experiencing homelessness.
 
Under McKinney-Vento the term "homeless children and youth" means individuals who lack a fixed, regular, and adequate nighttime residence, including students who are:
  • Sharing the home of other persons due to loss of housing, economic hardship, or similar reason
  • Living in motels, hotels, or camping grounds due to lack of alternative, adequate accommodations
  • Living in emergency & transitional shelters
  • Abandoned in hospitals
  • Living in public or private places not designed for or ordinarily used as regular sleeping accommodations for human beings
  • Living in cars, parks, public spaces, abandoned buildings, bus or train stations, or similar situations
  • Migratory children living in the above situations
 
McKinney-Vento Student Rights
 
Students that meet the eligibility requirements under McKinney Vento are entitled to the following rights:
  • Immediate school enrollment, even if lacking documentation typically required for enrollment
  • Enroll in local school district, or continue attending their school of origin (the school they last attended when permanently housed or the school they were last enrolled), whichever is in the student's best interest
  • Receive transportation support to and from their school of origin if requested
  • Remain in their school of origin for as long as they are still homeless or for the remainder of they school year if they find residency outside of the district
  • Participate in the same activities and programs offered to other children, including free and reduced school nutrition and Head Start programs, as well as appropriate special education and Title 1 programs
